1. Introduction
These Terms & Conditions apply to all services provided by Philbeach Contracts. By booking an appointment or requesting services, you agree to be bound by these terms.
2. Services Provided
Philbeach Contracts provides:
Residential Energy Performance Certificate (EPC) assessments
EPC lodging on the official government register
Energy efficiency guidance and rating improvement advice (where requested)
All services are carried out in accordance with current UK legislation and accreditation requirements.
3. Booking & Appointment Confirmation
Bookings may be made via:
Website form
Email
Telephone
An appointment is confirmed once agreed by both parties.
The client is responsible for ensuring accurate property details are provided at the time of booking.
4. Access to the Property
The client must ensure:
Access to all rooms within the property
Access to the boiler and heating controls
Safe access to the loft (if applicable and reasonably accessible)
Clear access to windows for measurement
Failure to provide adequate access may result in delays or the need for a return visit, which may incur an additional charge.
The assessor will not enter unsafe areas or undertake any action that may compromise health and safety.
5. Fees & Payment
Fees will be confirmed prior to the appointment.
Payment terms:
Payment is due upon completion of the inspection unless otherwise agreed.
The EPC will typically be lodged within 24 hours of inspection, provided payment has been received.
We reserve the right to withhold lodging of the EPC until payment is made in full.
All prices are quoted in GBP.
6. Cancellations & Rescheduling
If you need to cancel or reschedule:
At least 24 hours’ notice is requested.
Late cancellations or missed appointments may incur a fee.
If we need to cancel due to unforeseen circumstances, a new appointment will be offered at the earliest availability.
7. EPC Assessments
EPC ratings are calculated using government-approved software and methodology.
The rating reflects:
The condition of the property at the time of inspection
Visible and evidenced elements
Documentary proof provided
We are not responsible for:
Future changes in legislation
Alterations made after the inspection
Assumptions required where evidence is unavailable
The EPC is valid for 10 years unless superseded by a new certificate.
8. Rating Improvement Advice
Where additional advice or upgrade guidance is provided:
Recommendations are based on information available at the time
Cost estimates (if provided) are indicative only
Final results may vary depending on installation quality and product specification
We do not guarantee that specific improvements will achieve a particular rating unless explicitly agreed in writing.
9. Limitation of Liability
Philbeach Contracts maintains appropriate professional indemnity insurance.
Our liability is limited to the fee paid for the service, except in cases of negligence resulting in death or personal injury, fraud, or where liability cannot be legally excluded.
We are not liable for indirect or consequential losses.
10. Complaints Procedure
If you are dissatisfied with any aspect of the service, please contact us directly in writing.
If the matter cannot be resolved, you may refer the complaint to the relevant accreditation body (e.g. Elmhurst Energy), where applicable.
11. Data Protection
We process personal data in accordance with our Privacy Policy and UK GDPR requirements.
12. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
